1. Scope & Responsible Entity
This Policy applies to personal information processed in connection with Illuminaughty® online services that link to this Policy. The responsible business entity is Illuminaughty, LLC, 550 Congressional Blvd., Suite 390, #1052, Carmel, IN 46032, USA.
This Policy does not govern independent processing by third parties such as Amazon, external websites, or other services you choose to visit. Those third parties maintain their own privacy practices.
2. Information We Collect
The information collected depends on how you interact with the Services. We seek to collect information reasonably related to legitimate business, communications, security, legal, and operational purposes.
2.1 Information You Provide
- Contact information: name, email address, telephone number, postal address, or other information you choose to provide.
- Subscription and preference information: mailing-list status, consent status, unsubscribe status, and related preference records.
- Communications: messages, inquiries, feedback, legal notices, privacy requests, and other correspondence you send to Illuminaughty, LLC.
- Age-attestation information: information you enter to establish that you are at least eighteen (18) years of age. The website may evaluate age eligibility in the browser and store an eligibility state; Illuminaughty, LLC does not intentionally require retention of your full date of birth merely to remember a successful age-gate session.
2.2 Information Collected Automatically
- IP address and general network information;
- browser type, device type, operating system, and language settings;
- timestamps, referring pages, requested pages, and general navigation information;
- error, performance, security, and diagnostic information; and
- cookies, local storage, session storage, consent choices, age-gate state, and similar browser technologies where used.
We do not intentionally collect Social Security numbers, government identification numbers, biometric identifiers, precise geolocation, or full payment-card numbers through ordinary use of the Illuminaughty® website. Please do not send such information unless specifically requested through an appropriate lawful process.
3. Sources of Information
We may obtain personal information:
- directly from you when you subscribe, contact us, or submit a request;
- from your browser or device through ordinary web requests, logs, cookies, local storage, and similar technologies;
- from service providers that host, secure, maintain, email, analyze, or otherwise support the Services;
- from third-party marketplaces or referral programs where they lawfully provide referral or attribution information; and
- from public or legal sources where reasonably necessary for fraud prevention, intellectual-property administration, business verification, or legal compliance.
4. How We Use Information
Illuminaughty, LLC may use personal information to:
- operate, maintain, secure, and improve the Services;
- administer mailing-list subscriptions and preferences;
- send requested updates, product communications, and marketing messages;
- honor unsubscribe and privacy requests;
- respond to questions, legal notices, complaints, and correspondence;
- detect, investigate, and prevent fraud, abuse, unauthorized access, malicious activity, or violations of our Terms of Service;
- maintain business, legal, consent, security, and audit records;
- protect Illuminaughty, LLC, users, and third parties;
- comply with subpoenas, court orders, lawful government requests, and applicable law;
- analyze site performance and diagnose technical issues; and
- measure or attribute affiliate referrals where permitted.
5. How We Disclose Information
We do not sell customer or subscriber lists as part of our ordinary business model. We may disclose personal information when reasonably necessary to:
- service providers and processors performing hosting, infrastructure, email, security, analytics, technical maintenance, or similar functions on our behalf;
- professional advisers such as attorneys, accountants, insurers, auditors, or consultants where reasonably necessary;
- government authorities, courts, law enforcement, or regulators where required or permitted by law;
- protect rights, safety, property, security, or the integrity of the Services;
- investigate suspected fraud, abuse, unlawful conduct, or security incidents; or
- support a merger, acquisition, financing, reorganization, sale of assets, change of control, or similar business transaction, subject to applicable law.
6. Amazon Affiliate Links & Marketplace Data
Illuminaughty® Store contains Amazon affiliate links. When you select an Amazon link, you leave the Illuminaughty® website and interact with Amazon under Amazon’s terms and privacy practices.
Illuminaughty, LLC does not receive or store your Amazon password, full Amazon payment-card credentials, or complete Amazon order history merely because you followed an affiliate link. Amazon may provide referral, attribution, or commission information associated with qualifying affiliate activity according to Amazon’s program rules.
Amazon may use cookies, device identifiers, and other technologies on its own services. Those practices are governed by Amazon’s policies, not this Privacy Policy.
7. Cookies, Local Storage & Similar Technologies
The Services may use cookies, local storage, session storage, or similar technologies for essential site functions, age-attestation state, preference storage, security, performance, and related operational purposes.
The age gate may store an eligibility flag in your browser so that a verified adult user is not required to repeat the same attestation on every page during the applicable period. Clearing browser storage may cause the age gate to appear again.
You can control many browser-storage technologies through your browser settings. Disabling essential storage may affect site functionality.
8. Email & Marketing Privacy
Illuminaughty® marketing subscriptions are voluntary. If you subscribe, we may use your name, email address, subscription status, consent or preference information, and related campaign records to send requested product updates or promotional messages.
You may unsubscribe at any time using the unsubscribe mechanism included in a marketing email or by contacting Illuminaughty, LLC. We may retain a suppression record after an unsubscribe so that we can honor your request and avoid resubscribing the address inadvertently.
We do not require you to make an Amazon purchase in order to unsubscribe from Illuminaughty® marketing.
9. Data Retention
We retain personal information only for as long as reasonably necessary for the purposes described in this Policy, including operating the Services, maintaining subscription and suppression records, documenting consent, resolving disputes, protecting security, enforcing agreements, and complying with legal, accounting, or regulatory obligations.
Retention periods vary depending on the nature of the information, the reason it was collected, legal requirements, and legitimate business needs.
10. Security
Illuminaughty, LLC uses reasonable administrative, technical, and organizational safeguards appropriate to the nature of the information processed. No website, transmission method, or storage system can be guaranteed completely secure, and we cannot promise absolute security.
If we become aware of a security incident involving personal information, we will respond in accordance with applicable law and the circumstances.
11. Privacy Rights & Requests
Depending on where you live and whether an applicable privacy law covers Illuminaughty, LLC, you may have rights to request access, correction, deletion, portability, restriction, or other treatment of certain personal information.
We may need to verify your identity before completing a request. We may deny, limit, or charge for a request where permitted by law, including where an exception applies, the request cannot reasonably be verified, or the request is manifestly unfounded or excessive.
Authorized agents may submit requests where applicable law permits. We may require proof of authorization and may still need to verify the consumer directly where allowed.
12. U.S. State Privacy Rights
Residents of certain U.S. states may have additional rights under applicable state privacy laws if the law applies to Illuminaughty, LLC and the relevant processing activity. These rights may include access, correction, deletion, portability, and opt-out rights concerning certain forms of sale, sharing, targeted advertising, or profiling.
Illuminaughty, LLC does not sell customer or subscriber lists for monetary consideration as part of its ordinary business model. If our practices change in a way that triggers additional statutory opt-out duties, we will provide the controls required by applicable law.
Nothing in this Policy is intended to reduce rights that cannot lawfully be waived.
13. International Visitors
Illuminaughty, LLC is based in Indiana, United States. If you access the Services from outside the United States, information you provide may be processed in the United States or other locations where service providers operate.
Where mandatory law provides additional privacy rights or transfer protections, those rights remain applicable to the extent required by law.
14. Children & Minors
The Services are intended only for adults age eighteen (18) or older and are not directed to children. Illuminaughty, LLC does not knowingly invite or solicit minors to subscribe to adult-oriented marketing or access the eStore.
If you believe a minor has provided personal information through the Services, contact us so that we can review the matter and take appropriate action consistent with applicable law.
15. Third-Party Links
The Services may link to Amazon and other third-party websites. Illuminaughty, LLC does not control and is not responsible for a third party’s independent privacy practices, security, content, or policies. Review the third party’s privacy notice before providing personal information.
16. Changes to This Policy
We may update this Privacy Policy to reflect changes in the Services, business practices, legal requirements, security practices, or third-party programs. The “Last Updated” date above identifies the current version. Where applicable law requires additional notice or consent for a material change, we will provide it.
