These Terms of Service (“Terms”) govern access to and use of www.illuminaughty.store, the Illuminaughty® eStore, mailing-list and signup features, age-attestation features, and related website content and services operated by Illuminaughty, LLC (collectively, the “Services”). By accessing or using the Services, you agree to these Terms and acknowledge our Privacy Policy. If you do not agree, do not use the Services. Mandatory rights that cannot lawfully be waived remain unaffected.

1. Agreement & Scope

Illuminaughty® is operated by Illuminaughty, LLC. These Terms apply to the public website, eStore, forms, mailing-list functions, age-attestation features, content, links, and related online services that link to or incorporate these Terms.

Product-specific notices, third-party marketplace terms, or other disclosures may apply in addition to these Terms. If a lawful product-specific or third-party term directly conflicts with these Terms, the more specific term controls only for the product, transaction, or service to which it applies.

2. Adults Only; Eligibility & Age Attestation

The Services are intended solely for adults who are at least eighteen (18) years of age and otherwise legally permitted to access adult-oriented retail content in their jurisdiction. By entering or using the Services, you represent and certify that you satisfy those requirements.

The website may require a date-of-birth entry and an affirmative certification that the information provided is true and correct and that the user is at least eighteen (18) years of age. An age-attestation gate is intended to restrict access by minors but is not a substitute for any stronger age-verification method required by applicable law.

• circumvent access controls, age restrictions, rate limits, or security measures;
• impersonate Illuminaughty®, Illuminaughty, LLC, Amazon, another business, or another person;
• transmit malware, spam, fraud, unlawful content, or material that infringes the rights of others;
• remove or alter copyright, trademark, attribution, affiliate, or legal notices; or
• mirror, republish, resell, sublicense, or commercially exploit protected Illuminaughty® materials without authorization.

4. Intellectual Property

The Illuminaughty® name, logo, trade dress, original site design, original text, graphics, compilations, navigation, and other proprietary materials are owned by or licensed to Illuminaughty, LLC and are protected by applicable copyright, trademark, and other intellectual-property laws.

Illuminaughty® is a Registered Trademark in the United States & Other Countries. Nothing in the Services grants a license or right to use the Illuminaughty® name, logo, marks, trade dress, or other brand identifiers except as expressly authorized in writing.

Amazon names, product names, product images, third-party trademarks, and other marketplace content remain the property of their respective owners.

5. Amazon Affiliate Storefront

Illuminaughty® Store is an affiliate storefront. Product links may direct users to Amazon, where purchases are completed under Amazon’s applicable terms, policies, and checkout process.

As an Amazon Associate, Illuminaughty® may earn from qualifying purchases.

Illuminaughty, LLC may receive a commission when a user follows a qualifying affiliate link and completes an eligible transaction. The presence of a product or link does not mean that Illuminaughty, LLC is the seller of record, manufacturer, distributor, or fulfillment provider for that Amazon transaction.

6. Product Information, Pricing & Availability

We seek to present product names, images, descriptions, variations, pricing, and availability accurately, but marketplace information may change without notice. Prices displayed on the Services are informational and may be updated periodically.

The price, availability, variation, product condition, shipping terms, taxes, promotions, and other transaction information shown by Amazon at the time of purchase control the Amazon transaction. If information displayed by Illuminaughty® differs from Amazon’s current product page, Amazon’s current information controls.

7. Amazon Transactions, Shipping, Returns & Support

Amazon controls and administers Amazon-site ordering, payment processing, order acceptance, shipping, fulfillment, taxes, returns, refunds, exchanges, marketplace customer service, and account activity for purchases completed through Amazon.

Illuminaughty, LLC does not directly collect payment for Amazon purchases and does not control Amazon inventory, delivery times, marketplace order decisions, return eligibility, or refund timing. Questions about an Amazon order should generally be directed to Amazon or the applicable Amazon seller.

8. Communications & Marketing

If you voluntarily sign up for Illuminaughty® updates, you consent to receive marketing or promotional emails at the address you provide, subject to applicable law. You may unsubscribe from promotional communications using the unsubscribe mechanism provided in the message or by contacting Illuminaughty, LLC.

We may retain information reasonably necessary to honor an unsubscribe request, maintain suppression records, document consent, prevent abuse, or comply with law. An unsubscribe from marketing does not prevent legally required or directly requested communications where applicable.

9. Third-Party Services & Links

The Services may link to third-party websites and services, including Amazon and government or reference resources. Third parties operate independently and maintain their own terms, privacy practices, security, availability, content, and policies.

A link to a third-party service does not by itself create an endorsement, partnership, agency, sponsorship, or guarantee by Illuminaughty, LLC. Use of a third-party service is at your discretion and subject to the third party’s applicable terms.

10. Privacy & Browser Technologies

Our collection and use of personal information are described in the Privacy Policy. The Services may use cookies, local storage, session storage, or similar browser technologies for essential functionality, age-attestation state, preferences, security, and related operational purposes.

11. Service Availability, Changes & Errors

Illuminaughty, LLC may maintain, modify, update, replace, suspend, or discontinue any part of the Services from time to time. We do not guarantee uninterrupted access to the website, product feeds, third-party links, email features, or external services.

We may correct typographical, pricing-display, metadata, navigation, formatting, or technical errors when discovered. Temporary outages, maintenance, browser incompatibilities, network failures, third-party service failures, or security events may affect availability.

12. Disclaimers

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” ILLUMINAUGHTY, LLC DISCLAIMS WARRANTIES NOT EXPRESSLY PROVIDED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, AND UNINTERRUPTED OR ERROR-FREE OPERATION, EXCEPT TO THE EXTENT SUCH WARRANTIES CANNOT LAWFULLY BE DISCLAIMED.

Illuminaughty, LLC does not manufacture the third-party products linked through the eStore and does not warrant the safety, quality, performance, suitability, or regulatory status of products sold by independent third parties. Users should review product information, warnings, instructions, and seller information provided by Amazon or the applicable manufacturer or seller before use.

13. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, ILLUMINAUGHTY, LLC AND ITS OWNERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, AND AGENTS SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOSS OF PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY ARISING FROM OR RELATING TO THE SERVICES OR A THIRD-PARTY MARKETPLACE TRANSACTION.

Nothing in these Terms excludes or limits liability that cannot lawfully be excluded or limited.

14. Indemnification

To the maximum extent permitted by applicable law, you agree to indemnify and hold harmless Illuminaughty, LLC and its owners, officers, employees, contractors, affiliates, and agents from third-party claims, damages, liabilities, judgments, costs, and reasonable legal expenses arising from your unlawful use of the Services, your material violation of these Terms, or your infringement of another person’s rights.

15. Governing Law & Dispute Resolution

These Terms and disputes arising from them are governed by and construed in accordance with the laws of the State of Indiana, without regard to conflict-of-law principles, except where mandatory law requires otherwise.

Before filing a formal claim, the parties agree to attempt good-faith informal dispute resolution by providing written notice describing the dispute and requested resolution and allowing a reasonable opportunity to respond.

To the extent permitted by applicable law, disputes that are not resolved informally shall be submitted to binding arbitration on an individual basis, except for claims that applicable law requires or permits to proceed in court. Any arbitration shall be administered under mutually applicable procedures by a neutral arbitrator selected in accordance with those procedures.

For any judicial proceeding that is not subject to arbitration, and except where a different forum is required by mandatory law, the parties consent to personal jurisdiction and venue in a court of competent jurisdiction located in or serving Carmel, Hamilton County, Indiana.

16. General Terms

Severability

If any provision of these Terms is held unlawful, invalid, or unenforceable, that provision will be severed to the minimum extent necessary and the remaining provisions will remain in effect.

No Waiver

Failure to enforce a provision is not a waiver of that provision or any other right.

Assignment

You may not assign your rights under these Terms where doing so would materially increase our obligations without our consent, except where applicable law provides otherwise. Illuminaughty, LLC may assign or transfer these Terms in connection with a reorganization, merger, acquisition, sale of assets, change of control, or transfer of the Illuminaughty® business, subject to applicable law.

Entire Agreement

These Terms, together with the Privacy Policy, Copyright Notice, Equal Opportunity & Workplace Policies, and any applicable product-specific or third-party disclosures, constitute the entire agreement governing use of the Services to the extent legally applicable.

17. Changes to These Terms

Illuminaughty, LLC may update these Terms to reflect changes in the Services, business operations, third-party programs, legal obligations, privacy practices, or security practices. The “Last Updated” date above identifies the current version. Changes apply prospectively when posted unless a later effective date is stated or applicable law requires additional notice or consent.
